Comprehensive Immigration Reform

This writer believes that Comprehensive Immigration Reform requires a two prong approach and probably two bills in the Congress. Effective reform must be accomplished in the following two steps:
1. The Border between Mexico and the United States must be secured to prevent ANY further illegal crossing.
2. A comprehensive plan for dealing with the current estimated 12 million Mexican illegal aliens must be developed.
By way of background, the Immigration and Naturalization Act of 1965 amended the immigration law of 1952. Therein the Congress replaced the national origins system with a preference system designed to reunite immigrant families and attract skilled immigrants to the United States. After this, a wave of 4.3 million illegal Mexicans crossed into the United States.
The Congress’ next effort at dealing with illegal immigration would then wait 20 years. This effort was called the Immigration Reform and Control Act of 1986 which:
1. Permitted most illegal aliens who had resided in the U.S. continuously since January 1, 1982 to apply for legal status [Amnesty 1];
2. Established sanctions prohibiting employers from hiring, recruiting, or referring for a fee aliens known to be unauthorized to work in the United States. It also mandated penalties for violations; and,
3. Created the new classification known as Temporary Agricultural Worker and provided for the legalization of certain such workers.
Since 1986, a period of nearly 25 years, there has been nothing but talk from the politicians in Congress as they have worked at controlling, for political purposes, the Hispanic vote. This is in spite of an oath each of them have taken to defend the Constitution against all enemies foreign and domestic. Because of this it is estimated that there are now some 12 million Mexican illegal aliens [invaders] within the United States.
These “invaders” made a conscious decision to enter the United States against the law. It has caused no end to misery and death as unscrupulous individuals have charged large sums for a ride in the back of a truck or van resulting in death to many as they made their illegal crossing. It has created a whole series of social and legal problems for the United States and particularly the four States along the Mexico-United States border. It has over burdened our educational system and caused huge outlays of tax revenues to support many of the invaders who have not paid into the social justice system from which they benefit. Then to add insult to injury, they refer to themselves as Hispanic-Americans when in fact they are Mexican illegal aliens. Either you are an American or you are NOT. Make your decision and then either return to Mexico or apply for citizenship. If you want to be an American then support our Constitution and laws because in this nation we want no divided Americans.
That is why ANY plan for Comprehensive Immigration Reform MUST begin with securing the border between Mexico and the United States. I offer the following three step process:
1. Initially this must be done by the simultaneous militarization of the 1,951 mile border in all four states; CA, AZ, NM and TX, or the problem will just shift as it did from California to Arizona. This should be done quietly perhaps as an on-going joint Department of Defense and National Guard training exercise. It should be remembered that Mexico has ALREADY militarized their side of the border because of the drug cartels.
We as a nation do not need the violence south of the border spilling over in to our nation. There are already evidences that this happened with the home invasions, kidnappings and murders taking place in Arizona. These problems must be met head on and dealt with serious measures to protect the lawful citizens of the United States. Our citizens are our first responsibilities. Then we can be concerned with the Mexican refugees, who have fled the violence, and the Mexican illegal aliens who have been here for years.
2. Once this is accomplished the triple fence begun in California needs to be extended along the entire 1,951 miles of the Mexico-United States border. This fence should be a minimum of 10 feet high, with six foot “Y” outriggers installed on top with razor concertina wire connected to the “Y” outriggers.
3. Current Border Parol Checkpoints should be allowed to continue to operate at ALL present legal crossing points into the United States in all of the four mentioned States to allow legal entry and exit. Passports should be required for crossing in either direction at these checkpoints.
Once this is accomplished, consideration of what to do with the 12 million Mexican illegal aliens present in the United States can be tackled. Whatever is legislated in this regard MUST mirror the 12 step process for obtaining U. S. Citizenship.
Pathway to U.S. Citizenship[U.S. Citizenship and Immigration Services]
1. Be at least 18 years old at the time of filing the Application for Naturalization
2. Be a lawfully admitted permanent resident of the United States
3. At the time of filing the application, have been a permanent resident in the United States for at least 5 years [or for at least 3 years if you meet all eligibility requirements to file as a spouse of a United States citizen.]
4. Have demonstrated continuous permanent residence
5. Have demonstrated physical presence
6. Have lived within the State or USCIS District for at least 3 months prior to filing
7. Have demonstrated good moral character
8. Demonstrate an attachment to the principles and ideals of the U. S. Constitution
9. Demonstrate an ability to read, write, speak, and understand basic English
10. Demonstrate a basic knowledge of U. S. History, government, and civic principles
11. Swear an oath of allegiance to the United States
12. Receive a Certificate of Naturalization
With this in mind, I offer the following suggestions according to the numbers:
1. A wavier for minor children of the applicant so that they might remain with their parents until they may make application after reaching 18 and before their 19th birthday.
2. A wavier provided the applicant has been in the United States for more than 5 years or 3 years if a spouse of an United States citizen. [Mirrors item 3] [Amnesty 2]
3. Any Mexican illegal alien with less residency than as stipulated in 2 above would have to return to Mexico and return through the legal process.
5 and 6. No variance.
7. No variance. All felons, gang members, drug cartel personnel or associates shall be deemed to be without good moral character and will be listed as persona non grata. They will be permanently deported and NOT permitted to re-enter the United States or to apply for citizenship.
8, 9, 10, 11, 12. No variance
Two additional requirements should be added. First, the Citizenship process MUST be started within one year from the date the legislation becomes law. Second, that all requirements for citizenship MUST be accomplished within 5 years from the date of initial application. Any Mexican illegal alien NOT complying with these two provisions would have to return to Mexico and re-enter through the legal process.
With respect to employers hiring illegal aliens, penalties against the employers need to be stiffened and rigorously enforced. I would recommend a MANDATORY fine of $1000 and/or one year confinement for each undocumented employee found in their employ. With regards to the undocumented illegal aliens found in their employ, they should be detained and summarily deported according to due process.
This problem is 50 years in the making. It is past time for the Congress to become serious about its solution. We have always been a nation of immigrants. The world’s melting pot. It must be remembered however those who came to our shores prior to 1940 were genuinely INTERESTED in becoming United States Citizens. They wanted to be part of the American Ideal. They wanted to learn English and work to achieve their dreams in a land of freedom and prosperity. They wanted to grab the golden ring of freedom. They realized that our Constitutional Republic ONLY gave them the freedom to try, and the freedom to fail. They had no illusions. They knew they would have to work hard to achieve their dreams. They were just grateful for the opportunity that citizenship gave them in the greatest nation the world has ever known.
Can these attributes be ascribed to the 12 million Mexican illegal aliens within our borders today? Or do they just want a free ride at the expense of the American taxpayer? If they truly want the American dream, they should mirror the attitudes and actions of the immigrants that arrived on our shores prior to 1940. If they truly want the American dream, they should apply for citizenship with all its inherent responsibilities; otherwise, send them back to Mexico!
